
According to Article 5 of the 1991 Act of the UPOV Convention (regarding the CPVR system see Article 6 of Council Regulation (EC) No 2100/94), protection of a new breeding result requires that the same is distinct, uniform and stable (so-called DUS-requirements). Moreover, plant material of the variety must not have been distributed in certain terms prior to the filing of an application for grant of a CPVR (see Chapter I. 3) Novelty).
